PRIVACY STATEMENT

 

Hôtel des Horlogers Le Brassus S.A. ("HdH", "we", "us" or "our") takes your personal data seriously. The purpose of this statement (the "Privacy Statement") is to inform you about the processing of personal data that we may collect in the context of our activities, when you access our online and offline services. The activities deployed by HdH correspond to the traditional activities of the hotel industry, i.e. accommodation, catering, event organization and operation of a SPA.

HdH's Cookie Policy complements this Privacy Statement and describes what a cookie is, how it may be used by HdH and the means by which individuals may accept or reject the placement of a cookie operated by HdH on their device.

When you provide your personal data to HdH, HdH is responsible for collecting and processing your personal data in accordance with the Federal Data Protection Act of 19 June 1992 (DPA) and, to the extent applicable, the European Union's General Data Protection Regulation No. 2016/679, which entered into force on 25 May 2018 (GDPR).

We encourage you to take the time to read the Privacy Statement in its entirety. You may also request a copy of the Privacy Statement at our facility. We are available to answer any questions you may have at privacy@hdh.swiss , including in connection with the exercise of your rights with respect to your personal data described in Section VI.

 

I. PERSONAL DATA WE COLLECT

 

This Privacy Statement applies to personal data that we may collect from or about you (see below) from the following sources:

- Visiting our website and using our mobile app: including when you create and use an account on our website or dedicated booking site, respond to a form or use a service (subscribe to our newsletter, request contact, information or services), feature or resources published on our website. You will be asked to identify yourself, but you may also visit our site without registering;

- Oral, written or electronic communications, even if informal, between HdH and yourself, including during your visits to our facility;

- Printed or tablet-based application forms that we collect, including at our facility;

- Online application filings;

- Data you share publicly as part of your interaction with HdH on social networks (for example, when you "like" an HdH page on social networks, such as Facebook, Instagram, and Linkedin).

- From third parties (such as companions or travel agencies).

We may collect different types of information about you depending on the purpose and the manner in which you or your companions interact with HdH (verbally, in writing or electronically), as described below:

- Identity and contact information: this is any information you provide to us that would allow us to contact you, such as your name, personal or business contact information, and the contact information of the people accompanying you on your trip. 

- Information about your stay: arrival and departure dates, goods and services used, special requests, comments about your service preferences (rooms, food and beverages, spa treatments), telephone numbers dialed, faxes, text messages, and phone messages received. The information you share in connection with special requests may include information about health or religious conditions that require special accommodations or diets.

 

- Personal status, preferences and background: any information that describes your demographic and behavioral characteristics. Examples include your date and place of birth, gender, nationality and passport/visa information, language preference, employment status (job title, company/employer), marital status, interests (sports, hobbies, art) or lifestyle, and other preferences and history of services you have requested.

 

- Feedback: This is information that you voluntarily share with us about your experience using our services (for example, in the event of a complaint, satisfaction surveys, or during discussions, even informal, with our employees).

 

- Social Network Information: We may have access to information that you share publicly on third party social networks, such as the social networks listed above. If you wish to stop sharing this information, we recommend that you review the terms of use of the relevant social network.

 

- Payment Information: Any information we need to fulfill a reservation or that you use to make a payment (credit card holder name, card number, expiration date, copy of your ID, etc.) and information or documentation required by anti-money laundering and embargo laws as part of know-your-customer checks. When necessary to protect HdH's assets, this information may also include information about the creditworthiness of customers.

- Information collected while you are at our facility through the use of video surveillance systems, Internet systems, key cards or other security and technology systems, and copies of your identification documents;

- Traffic and Usage Data: When you interact with our site, we may collect traffic data through automated data collection technologies, including a dialogue between the website server and your browser. Traffic data may include the name of the browser and the type of device you are using, as well as technical data about how you connect to our site, such as your operating system, the IP address of your Internet-connected device, the identifier of your Internet access point, the date and time of your last visit, and the Internet service providers you use. This data is used for statistical purposes and its analysis is used to improve our site, to provide you with a personalized browsing experience tailored to your preferences and interests, for example by displaying pages directly in your preferred language on your next visit. This information is captured using automated technologies such as cookies (browser cookies) and web beacons (such as Java Script) and is also collected by external tracking services (Google Analytics). Sensitive Personal Data. In certain circumstances, personal data that you provide to us or that we collect from you may constitute so-called sensitive personal data under the privacy laws of certain countries. Examples of sensitive personal data under these laws include personal data that can be used to determine an individual's racial or ethnic origin, political opinions, religious or other similar beliefs, membership in a trade union or professional organization, mental or physical health, medical treatment, genetic information, sex life, or judicial information.

 

In particular, we may process personal data about your health or religion that you provide to us in order to meet your needs and provide you with the most appropriate services possible. This sensitive personal data is not collected automatically but only if you provide it to us and is only processed to anticipate and meet your specific needs and expectations. Under no circumstances do we use this data for other purposes, in particular for marketing purposes.

 

By providing us with this data, you give your express consent to the processing of any personal data you provide to HdH that is considered sensitive personal data, provided that it is processed in accordance with our Statement. Except where required by law, you are under no obligation to provide HdH with sensitive personal data of any kind, and if you choose not to do so, this will not prevent you from using HdH services.

 

II. USE OF YOUR PERSONAL DATA

 

We collect and use your Personal Data on one or more of the following legal bases:

- We have obtained your prior consent (for example, when you subscribe to our newsletter). Please note that with this particular legal basis, you have the right to revoke your consent at any time (see chapter VI) ;

- The processing is necessary in the context of a contract between HdH and you (e.g. when you book a room);

- We have a legitimate interest in carrying out the processing and this legitimate interest is not overridden by your interests, fundamental rights or freedoms (e.g. prevention against fraudulent or illegal activity) ;

- We must process your personal data in order to comply with applicable laws and regulations.

Depending on the context, we may use your personal data for the purposes described below. Please note that the types of use listed below depend on the use you make of our services and do not systematically concern each user:

- to manage your stay with our establishment and to offer you services adapted to your expectations and needs;

- process your hotel reservations and other services;

- to provide and bill for hotel rooms and other goods and services;

- respond to your requests for information and services, requests and/or questions, including requests to exercise your rights;

- improve customer service, personalize and manage our relationship with you, including managing VIP programs, loyalty programs and events. The data collected, which can be cross-checked from the different sources mentioned in chapter I., helps us to answer your requests, to satisfy your needs more efficiently and to improve our offer according to your preferences and the history of your relationship with HdH;

- send you regular information, in particular about our establishment, our events, our activities, our promotional offers or satisfaction surveys concerning our services, with your consent when required;

- Send you advertising offers and chat with you on social networks when you interact with third-party social network features such as "like" functions. We recommend that you review the terms of use of the relevant third-party networks to learn about these features and, if necessary, terminate your registration;

- manage our site and the services offered on it, including personalizing and facilitating your user experience on our site by presenting you, when you visit our site, with HdH-specific content that corresponds to your interests. We may also aggregate this data to better understand how users, as a group, use the services and/or resources available on our site;

- to respect our obligations in terms of invoicing and accounting, as well as our legal and regulatory obligations (including those relating to anti-Covid measures)

- to deal with any claims and disputes (including in connection with the exercise of legal claims and defences to litigation);

- produce reports and statistics, including for the purpose of measuring site traffic

- to manage the recruitment process for applications submitted to the site;

- to ensure the security of our facility and to protect our staff, customers and other visitors, and our assets from inappropriate and harmful customer behavior that may compromise safety or security (including property damage, aggressive and inappropriate behavior, theft, vandalism, non-payment)

- to guarantee the security of computer systems and operations.

 

III. HOW WE PROTECT YOUR PERSONAL DATA

 

We have put in place organizational, human and technical measures to adequately protect your personal data, as well as the processing of your personal data by us. The measures applied, in order to avoid any unauthorized access to your personal data and their alteration, disclosure or destruction, follow recognized information security standards. These security measures consist mainly of strict access control, encryption of personal data in our customer and potential customer databases, regular access reviews, maintaining the infrastructure at an adequate level of protection, constant supervision of the infrastructure, and a strategy for analyzing and remedying potential security incidents.

However, while we strive to protect your personal data in our possession, we cannot guarantee the security of information transmitted to our site while in transit over the Internet using an unsecured protocol.

 

IV. SHARING YOUR PERSONAL DATA

 

We will not sell, trade, rent or otherwise transfer your personal data without your consent (which will have been given upon receipt of prior information) and subject to the circumstances listed below:

We may share your personal data with companies affiliated with HdH or with third parties located abroad, for the following purposes:

- We may use third-party service providers to help us operate our facility (e.g., in connection with reservations, payment processing, sending newsletters, organizing events, providing transportation, managing our information systems, etc.), administer our site and the services offered on it, including through the use of Google Analytics, as described in the Cookie Policy. - For the purposes described in Section II above, we may share with our business and advertising partners aggregated demographic information, by groups of users (which does not contain any direct identification of our visitors), for statistical purposes and for advertising HdH services.

- We may disclose this data to a third party entity in connection with a merger or acquisition, or to any organization involved in a transfer or sale of our business or assets.

We will always require such third parties to provide adequate privacy and security safeguards and to take the necessary organizational and technical measures to protect your personal data in accordance with applicable law. When we transfer personal data to a country that is not designated by the Federal Data Protection and Information Commissioner or by the European Commission as providing an adequate level of protection for personal data, the transfers are governed by the applicable contractual clauses adopted by the European Commission and endorsed by the Commissioner or through mechanisms validated by them or by the competent authorities in charge of personal data protection within the European Economic Area and, where applicable, supplemented by measures that may be required in other jurisdictions. Furthermore, service providers are only allowed to access and use your personal data on our behalf in connection with the specific tasks assigned to them, based on our instructions.

The list of countries to which we transfer personal data may change. You can request an updated list of countries to which we may transfer your personal data for specific purposes from the address indicated in Section VIII "Contacting Us".

In addition, we may disclose personal data to third parties to comply with legal requirements, to respond to a request from a competent law enforcement agency, to exercise our rights or defend ourselves in a claim or legal proceeding, or to provide evidence and protect the interests of HdH or an affiliate.

 

V. RETENTION OF YOUR PERSONAL DATA

 

We keep your personal data for the period of time necessary to fulfill the various purposes defined in Chapter II above, except in cases where the law authorizes or requires us to keep them longer.

In particular:

- Personal data used to manage our relationship with you or to send you information, in particular about our establishment, new services, events or satisfaction surveys will be kept for the time necessary to manage our relationship with you, and for a maximum of five years from the end of your commercial relationship with HdH or your last use of the services available on our Site or your last contact with HdH. 

- Data related to the management and history of your purchases and services provided, as well as to the management of complaints will be kept for a maximum of ten years from the last event.

- Personal data processed for the management of requests for access and rectification of personal data will be kept for a maximum period of three years.

These maximum periods apply unless you request the deletion or the cessation of use of your data before the expiry of these periods for a reason compatible with a legal obligation of conservation which would be imposed on HdH.

 

VI. YOUR RIGHTS REGARDING YOUR PERSONAL DATA

 

Access to personal data, modification, updating and deletion: you may (i) request access to your personal data held by HdH, consult them and obtain a paper or electronic copy, and (ii) request the correction, limitation, updating or deletion of your personal data or object to their processing. You may exercise these rights by sending a written request, together with a copy of your identification document, to the postal or e-mail address indicated in Section VIII "Contact Us" below. We will endeavour to present you with the relevant personal data, correct or delete it, depending on your request and in accordance with the applicable law.

Please note that deleting or limiting the processing of some or all of your personal data may limit our ability to serve you. In addition, in some cases, we may need to retain some of your personal data after your request for deletion in order to comply with our legal or contractual obligations. We may also be permitted by applicable law to retain some of your personal data to meet our legal obligations.

Opt-out: You may also at any time request to no longer receive information or offers from us, either by following the unsubscribe process described in the messages you receive from us or by writing to us at the address listed in Section VIII "Contacting Us" below. If you do so, we will promptly update our database and take all reasonable steps to respond to your request as quickly as possible, but we may continue to contact you as necessary in connection with any product or service you have requested.
